For most digital products, Geoscience Australia requires a signed licence agreement to be completed by the customer before a licence is granted. Because copyright is retained over the data, Geoscience Australia sells a licence to use data rather than selling the data itself. For some products, a licence is granted upon a gesture signifying agreement to the licence conditions, for example breaking the seal on a product or selecting a button on the website.
Under the Spatial Data Access and Pricing Policy datasets defined as a 'packaged product' are subject to the terms and conditions of this licence template [PDF 120KB], a full licence will be included with product.
Under the Spatial Data Access and Pricing Policy datasets defined as a 'customised product' are subject to the terms and conditions within the Order Form and Licence for Customised Digital Map Product [PDF 190KB], a full licence will be included with product.
If you wish to order a customised product, fill out the above form and return it with the required licence fee to Geoscience Australia Product Support and Distribution (Sales Centre).
Under the Spatial Data Access and Pricing Policy datasets defined as 'free downloadable products' or 'online products' are subject to the terms and conditions of this licence template [PDF 120KB].
There is no licence fee for downloadable products from the Geoscience Australia website, all you need to do is register and agree to the online product licensing conditions and where relevant, we will send you an access key to enable you to freely download the product.

Data that has a Product Specific Licence is supplied to customers under a non-exclusive, non-transferable licence to use the data for non-commercial applications within the customer's organisation only. The data, documentation, or any product derived from the data, either digital or hardcopy, must not be sold, given away, traded, let, hired or otherwise dealt with. Should the customer wish to use the data commercially, a special licence (explained under Commercial applications below) for this purpose must be obtained from Geoscience Australia.
The customer is permitted to use the data in demonstrations and displays, provided a statement acknowledging that the data was supplied by Geoscience Australia and a notice of copyright to the Commonwealth of Australia is shown on the demonstrated or displayed product. Full details of the conditions of use of Geoscience Australia data products are contained in the Product Specific Licence agreements.
National Mapping supplies digital map products to customers under a non-exclusive, non-transferable licence to use the data. If you use or wish to distribute the data in its current form, you must make your customers or end users aware that the data was sourced from Geoscience Australia under licence. In addition, you must record distribution details (eg contact details, organisation name, date of transfer etc) as these details may be requested by Geoscience Australia in the future.
If you or your organisation distribute the data you have either downloaded (online product) or purchased (customised or packaged products), you must include the following copyright statement with the data:

In general terms, copyright is the exclusive right given to an author by the Copyright Act 1968 (and amended) to reproduce, publish, perform, broadcast and adapt a work.
Geoscience Australia is the custodian of the copyright of the maps and data products it produces on behalf of the Australian Government, ie. the Commonwealth. Geoscience Australia does not give away copyright. Rather, it grants a right to use its products as specified in any application, ie, a licence.
In the case of all satellite image products, with the exception of LANDSAT products, the Satellite Operator holds the copyright of the imagery. However, Geoscience Australia is authorised to license the data on behalf of the Operator.
